WOTUS Update

A federal judge in North Dakota, Ralph Erickson on August 27 has blocked the Obama Administration rule of the Water of the U.S. (WOTUS) hours before it came into effect thanks to the injunction of 13 states, Alaska, Arizona, Arkansas, Colorado, Idaho, Missouri, Montana, Nebraska, Nevada, New Mexico, North Dakota, South Dakota and Wyoming. Other states have filed an injunction in other two districts, including Texas. However, the judge in each of the two districts has ruled that it was jurisdiction of an appellate court and declined to rule. The Environmental Protection Agency (EPA) has, therefore, immediately enforced the rule on the other 37 states.

The above thirteen states have asked Judge Erickson today to apply the injunction nationally and he agreed to consider it. We might have his ruling by the end of the week. Below is a link to a concise article to explain the legal action as of today.
