Message to Key Senators:

The EPA rule on Waters of the United States went into effect August 28th for 37 states, with 13 states granted a preliminary injunction to halt implementation. The court’s decision echoes the concerns the Army Corps of Engineers laid out in several memos that this rule is “legally vulnerable, difficult to defend in court, difficult for the Corps to explain or justify and challenging for the Corps to implement.”

In light of the serious concerns the Corps has raised, and the fact that there is still a huge amount of confusion and uncertainty within the regulated community, we ask your support of the bipartisan bill S 1140 which would withdraw and repropose the rule. Please urge the EPA to listen to their co-regulator, the Army Corps of Engineers about the serious flaws in this regulation.
