NRA Supports Cornyn’s Bill

Senator John Cornyn (R-TX), on the request of the National Rifle Association (NRA) has filed in August S. 2002 to protect the Second Amendment rights of law-abiding citizens.

The bill clarifies that an adjudication under the Gun Control Act’s (GCA) mental health provisions will require due process protections, including a full hearing in which an individual has notice, the opportunity to participate, and the right to legal advice. The conclusion of this due process must be clearly defined and focused solely on adjudications that involve individuals who are a danger to themselves and others.

The bill also removes the category ” lacks the ability to contract or manage affairs” as relevant to classify anyone as a prohibited person under the GCA.

This provision was used as an excuse used by the Veteran Affairs and the Social Security Administration (SSA), and considered by other agencies under Pres. Obama’s directive, to sweep broad swaths of the American public into National Instant Criminal Background Check System (NICS).

Furthermore, the bill would give relief to many other Americans from the prohibition to own firearms, like those whose record has been expunged, who are no longer subject to an order for a treatment, and those who have been granted relief from a state program.

The bill further requires the Attorney General to remove from NICS the record of any person who would not be considered prohibited under the new requirements of the bill

The Obama Administration is currently forwarding all individuals receiving benefits from the (SSA) through a representative payee to the NICS as “prohibited persons” under the federal firearms laws without due process. This latest gun grab is affecting over 4 million people.
